1. These terms
These terms govern your use of GidaHaven, an online property marketplace operated by GidaHaven Tech Limited (RC RC-9816316) in Nigeria. By creating an account, publishing a listing, contacting a lister, buying a paid service or otherwise using the service, you accept them. If you do not accept them, do not use the service.
Our Privacy Policy, Cookie Policy, Verification Policy, Community Guidelines and Boost & Spotlight Refund Policy form part of this agreement.
2. What we are, and what we are not
We run a marketplace. Owners, landlords, agents and property businesses advertise property here, and buyers and renters find it and make contact. That is the whole of our role.
We are a marketplace operator and technology platform. We are not an estate agent, broker, property manager, valuer, surveyor, lawyer, conveyancer, landlord, seller, buyer, tenant, or a party to any property transaction. In particular, we do not:
- own any property advertised here;
- act as the agent of a lister or of a property seeker;
- negotiate, or set the terms of, any sale, lease or tenancy;
- hold deposits, rent or purchase funds for anyone;
- guarantee that a property exists, is available, or is as described;
- guarantee that a lister will complete a transaction;
- inspect or visit properties; or
- provide legal, valuation, surveying or title advice.
Any agreement to buy, sell, rent or lease is between you and the other party alone.
3. Safety — please read this
Property transactions carry real financial and personal risk. Before you pay anyone anything, verify the property, confirm that the person you are dealing with owns it or is authorised to let or sell it, and check the documentation yourself.
Consumer Advisory for Buyers & Renters
Many listers are agents, family representatives or caretakers rather than the registered title-holding owner of the property they advertise.
Never assume a listing or a lister is safe because it appears here, or because it carries a verified badge. A badge means only that we confirmed their identity details under our Verification Policy. It is not a guarantee of ownership, title, condition, availability, honesty, or the outcome of any deal.
If you are defrauded: report the listing with the Report button. We can freeze or ban the lister’s account, which hides all their listings, and we may give the Nigeria Police Force or the EFCC the details we hold about the lister where they ask for them or the law otherwise allows. We cannot recover money you have sent. Read our Safety & Anti-Fraud guide for immediate steps.
4. Eligibility and minimum age requirement (18+)
You must be at least 18 years of age and legally capable of entering into enforceable contracts under Nigerian law. Minors (individuals under the age of 18) are strictly prohibited from registering accounts, publishing listings, serving as estate agents, or executing property transactions on GidaHaven.
If you use the service on behalf of a company, agency or other organisation, you confirm that you are authorised to act and to accept these terms on its behalf, and that it will comply with them.
We reserve the right to request proof of age and identity documentation at any time, and we will terminate any account found to be operated by or on behalf of an underage individual.
5. Your account
You are responsible for:
- giving accurate registration details and keeping them current;
- keeping your password confidential;
- everything done through your account; and
- telling us promptly at support@gidahaven.com if you think your account has been used without your permission.
You must not:
- register using another person's identity without their authority;
- impersonate any person or business;
- open or use another account to get around a freeze, a ban or any other restriction;
- sell, transfer or share your account without our permission; or
- give false information when registering or applying for verification.
6. Listing property
By publishing a listing you confirm that:
- you own the property, or the owner has authorised you to advertise it;
- the property exists and is genuinely available as advertised;
- the price, rent, fees, location, description and availability are accurate and not misleading;
- the photographs and videos show the property advertised, and you may lawfully use them;
- every mandatory charge a buyer or renter will be asked to pay is disclosed; and
- advertising the property breaks no law and infringes nobody's rights.
You must promptly update or remove a listing when the property is sold or let, when the price or a material fee changes, when availability changes, or when you no longer have authority to advertise it.
You must not use a listing to collect enquiries for a property you cannot actually provide.
7. Fees shown in listings
Listers must disclose the material costs of the transaction. Depending on the property this can include the purchase price or rent, agency fees, legal fees, service charges, caution or security deposits, inspection fees and other mandatory charges.
A listing must not be made to look cheaper by leaving out charges the buyer or renter will have to pay. We may require a listing to be corrected where fee information is incomplete or misleading, and may remove it if it is not.
8. Review of listings and listing limits
Listings you submit are normally held for review by our team before they appear. Where an administrator has enabled automatic publishing, listings from listers who have passed identity verification may go live immediately; all other listings are reviewed first.
Until an account has been verified, the number of listings it can have active at one time is capped. The current cap is shown to you when you hit it.
We may reject, hide or remove any listing that breaks these terms, and may hide a listing that attracts credible reports of fraud while we investigate. Review is not a guarantee that a listing is accurate or lawful.
9. Your content
You keep ownership of the photographs, videos, descriptions and other content you upload (“your content”).
You grant us a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, resize, adapt for technical purposes, display and distribute your content as reasonably necessary to operate and promote the marketplace. That includes showing your listing on the service and in search results, and featuring it in our marketing and on our social media channels.
You confirm you hold the rights needed to grant that licence. The licence ends when you delete the content, except for copies we need to keep for legal, security, fraud-prevention or dispute purposes. We may remove or refuse to publish content that we reasonably believe breaks these terms or the law.
10. Verification
We may grant a verified badge to a lister who submits identity details we review and accept. The checks we carry out — and the many we do not — are described in full in our Verification Policy.
We may approve or refuse a request, ask for more information, and suspend or remove a badge at any time, including where information we relied on turns out to be false or can no longer be relied upon. We do not guarantee that a verified user will act honestly or lawfully after being verified.
11. Prohibited conduct
Our Community Guidelines set out expected behaviour in full. You must not:
- advertise a property that does not exist, or that you have no authority to advertise;
- leave a sold or let property advertised as available;
- publish false, misleading or deceptive information, or manipulate price or availability to attract enquiries;
- use photographs or other content you have no permission to use;
- collect inspection fees, deposits or other payments for a property you cannot provide;
- create fake listings, fake accounts or fake reviews;
- impersonate another person, agent, company or owner;
- harass, threaten, abuse or discriminate against anyone;
- use contact details obtained here for spam or for anything other than the enquiry they relate to;
- scrape, crawl, harvest or bulk-extract listings or user information, or build a competing database from them;
- use automated systems to access the service other than as we permit;
- attempt to access another account, interfere with the platform's operation or security, introduce malicious code, or circumvent technical restrictions; or
- use the service to facilitate fraud, money laundering or any other unlawful activity.
Nothing here prevents search engines indexing public pages where we permit it.
12. Anti-fraud enforcement & police referrals
Every property page has a Report button. When a report is received our team reviews the listing and the lister, and may remove the listing, revoke the lister’s verified badge, and freeze or ban the account (see section 19).
Anti-Fraud Terms & Law Enforcement Disclosure
Listers must only advertise property they are genuinely authorised to advertise.
By creating an account or publishing a listing on GidaHaven, you agree that:
- If you are credibly reported for fraud, or we reasonably suspect it — for example taking advance fees for a property you cannot provide, or misrepresenting who owns it — we may disclose the personal details we hold about you to the Nigeria Police Force, the Police Special Fraud Unit, the Economic and Financial Crimes Commission (EFCC), other prosecuting authorities and the courts, where the law allows or requires it. Our Privacy Policy lists exactly what we hold and how a disclosure is handled, and we record every disclosure in a log.
- If you verify through our team, we keep the ID photo and selfie you give us for as long as your account exists and for one year after you delete it, and may hand them to those authorities on a lawful request or where the law otherwise allows. After that year they are deleted. Deleting your account does not end this period.
- Fraud is a crime in Nigeria, and you can be sued for the losses it causes. Those are matters for the courts; nothing in these terms limits them.
For buyers and renters: report a scammer to us with the Report button and we can freeze or ban their account. Please also report the crime to the police or the EFCC yourself, and keep your evidence — payment receipts, messages and call logs. We cannot recover money you have sent.
13. Search results and promoted listings
We order listings using factors including relevance to the search, location, property characteristics, completeness of the listing, recency, verification status and how users interact with it.
We also sell promotion, which makes a listing appear more prominently: a share of the positions in our feeds, and a fixed number of spotlight positions that are booked by the day. A promoted listing is identified as promoted. It is not necessarily the most suitable property for you, and promotion is not an endorsement or guarantee by us.
14. Paid services, boosts and spotlights
We show the price and the material terms before you buy. A boost increases the prominence of a listing for a fixed period. A spotlight reserves one of a fixed number of positions — on our home page or at the top of a district page — for the calendar days you book, at a price per day. Neither guarantees views, enquiries, leads, offers, a sale, a tenancy, a particular position in results, or any financial outcome.
A booked spotlight is held for you while you pay for it. If the payment is not completed, the hold ends, the days return to sale, and you are not charged.
A boost or spotlight belongs to the listing and account it was bought for and cannot be transferred unless we allow it. We may cancel, remove or end one where the listing breaks these terms, is fraudulent or misleading, where the account is suspended for misconduct, or where we must remove the listing by law.
Boosts and spotlights are not refundable because you changed your mind, received fewer views or enquiries than you hoped, or sold or let the property. Where we end a spotlight before the last day you booked, we refund the days it did not run; where we fail to deliver a placement you paid for, the Boost & Spotlight Refund Policy sets out what we will do.
15. Payments
Where we charge you:
- you agree to pay the price shown;
- you authorise the payment provider to take the payment;
- you must give accurate payment details and must not use a payment method you are not authorised to use; and
- you are responsible for any taxes the law requires you to pay.
Payments are handled by third-party payment providers, whose own terms and privacy policies apply to the transaction. We never receive or store your card details. We may suspend a paid service where a payment is reversed, disputed or not completed. Nothing here limits a refund right that cannot lawfully be excluded.
16. Intellectual property
Apart from your content, we and our licensors own everything in the service — the GidaHaven Property name and branding, logos, interface and design, software, databases, search and ranking systems, text and graphics.
You may use the service for its intended purpose under these terms. You must not copy, modify, distribute, sell, license, reverse engineer or commercially exploit any part of it without our written permission, except where the law expressly allows it.
17. Third-party services
We use and link to third-party services, including hosting, media storage, email, payments and mapping. They operate independently, under their own terms and privacy policies, and to the extent the law allows we are not responsible for them.
18. Privacy and service messages
How we handle personal data is set out in our Privacy Policy, which also explains how to exercise your data-protection rights.
By using the service you accept that we may send you messages needed to run your account — account and security notices, verification updates, enquiry notifications, payment notices, and notice of important changes. Marketing messages, if we ever send them, will be subject to consent and you will be able to opt out.
19. Freezing, banning and closing your account
You may stop using the service at any time and can close your account from Account Settings, except while it is frozen or banned.
Freezing. We may freeze an account while we look into a report or a concern — for example a credible report of fraud, or doubt about whether you may advertise a property. While an account is frozen:
- all your listings and deals are hidden from buyers, and your public storefront is not shown;
- you cannot publish new listings or deals, and cannot buy boosts or spotlights;
- you cannot delete your account;
- if you are a buyer or renter, you cannot write reviews or reveal a lister's contact details; and
- you can still sign in, see why, and contact us.
We tell you by email and on your dashboard, with the reason. Nothing is deleted. If the freeze is lifted, your listings and deals are put back as they were.
Banning. We may ban an account for serious or repeated breaches of these terms, including fraud, advertising property you have no authority to advertise, impersonation, and trying to get round a freeze or an earlier ban. When an account is banned you can no longer sign in, your listings and deals are hidden, any running boost or spotlight ends without a refund, and fees you have paid are not refunded. We keep the banned account, and the details described below, for one year from the ban and then delete them. If a ban is lifted earlier, the details are deleted at once.
Banned details and new accounts. So that a banned person cannot simply start again, we keep the email addresses, phone numbers and names on the banned account, any CAC registration number, and the type and last four characters of any ID document you gave us for verification. We check new sign-ups, changes of email or phone number, and verification requests against them. A match does not block anyone automatically: it flags the account for our team, who review it and decide whether to freeze or ban it. You must not open or use another account to get round a ban. We keep them for one year from the ban, then delete them. Our Privacy Policy explains your rights over them.
Asking us to look again. If you think a freeze or a ban is a mistake, email support@gidahaven.com and tell us why. A person will review it, and we will lift the freeze or ban if we got it wrong.
We may also suspend, restrict or close your access where we reasonably believe that:
- you have broken these terms or given false information;
- the account is being used fraudulently or unlawfully;
- your activity creates a security or legal risk, or you have abused another user;
- credible complaints about you keep arriving; or
- we are required to act by law or a competent authority.
Where it is practicable we will give notice and a chance to put things right, but we may act immediately where that is needed to prevent fraud, protect people, preserve evidence or comply with the law. Closing an account ends any running boost or spotlight without a refund, and deletes your listings and their media as described in our Privacy Policy. Rights and obligations that arose before closure survive it.
20. Availability of the service
We aim for a reliable service but do not promise it will always be available, uninterrupted, secure or error-free. We may carry out maintenance, change or remove features, restrict access temporarily, or discontinue part of the service. Where it is practicable we will give notice of material changes.
21. Disclaimers
To the fullest extent the law allows, we do not guarantee:
- the accuracy or completeness of anything a user publishes;
- the availability, condition, quality or suitability of any property;
- the identity, honesty or conduct of any user;
- the ownership or title of any property;
- that a transaction will complete, or that another user will do what they promised;
- that the service will produce enquiries, sales or tenancies; or
- that your use of the service will be free from fraud or other unlawful activity by others.
We take reasonable steps to run a trustworthy marketplace — reviewing listings and reports, and applying verification and enforcement — but no online marketplace can remove all risk.
22. Our liability
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
Subject to that, and so far as the law allows, we are not liable for:
- the acts or omissions of any other user;
- inaccurate, misleading or incomplete content published by users;
- any property transaction between users;
- the condition, ownership or title of any property;
- money you pay directly to another user;
- loss of profit, business, opportunity or anticipated savings;
- indirect or consequential loss; or
- loss arising from your failure to carry out your own checks.
Where we are liable to you despite the above, our total liability for everything arising in any twelve-month period is limited to the greater of the total you paid us in that period and NGN 20,000.
None of this removes any statutory consumer right you have that cannot lawfully be excluded, including under the Federal Competition and Consumer Protection Act 2018.
23. Your responsibility to us
If your breach of these terms, your unlawful conduct, or content you published leads to a claim against us by someone else, you agree — so far as the law allows — to reimburse our reasonable losses, costs and legal expenses arising directly from it. This does not apply where the claim resulted from our own fraud or wilful misconduct.
24. Changes to these terms
We may update these terms. The effective date at the top of this page shows when the current version took effect, and we will give reasonable notice through the service of changes that materially affect your rights. Continuing to use the service after a change takes effect means you accept it; if you do not, stop using the service and close your account.
25. Complaints, disputes and governing law
Please contact us first at support@gidahaven.com so we can try to resolve the matter. Nothing in this section stops you exercising a statutory right or contacting a regulator.
These terms are governed by the laws of the Federal Republic of Nigeria. Disputes are subject to the jurisdiction of the courts of competent jurisdiction in Abuja (FCT), Nigeria, subject to any mandatory rights or jurisdiction the law gives you.
26. General
Severability. If any provision is found invalid or unenforceable, it will be narrowed to the minimum extent needed to make it enforceable, and the rest continues to apply.
No waiver. If we do not enforce a provision immediately, we do not lose the right to enforce it later.
Assignment. We may transfer our rights and obligations in connection with a merger, acquisition, restructuring or sale of assets. You may not transfer your account or your rights without our written consent.
Entire agreement. These terms and the policies they incorporate are the agreement between you and us about your use of the service, except where additional terms expressly apply to a particular service.
